What is the DPDP Act?
The Digital Personal Data Protection Act, 2023 (DPDP Act) is India’s law on how organisations collect, use, store and share digital personal data. The DPDP Rules, 2025 set out how it works in practice, including notices, consent, breach reporting, data retention and children’s data.
The Act is built around three groups:
- Data Fiduciaries: organisations that decide why and how personal data is processed must give clear notice, obtain valid consent or rely on a legitimate use, protect the data and report breaches.
- Data Principals: individuals have rights to access, correct and erase their data, to nominate another person, and to have grievances addressed.
- Significant Data Fiduciaries: organisations notified by the government have extra duties, including appointing a Data Protection Officer based in India, periodic data protection impact assessments and independent data audits.
What does a DPDP Act Lead Implementer do?
A DPDP Act Lead Implementer turns the Act and Rules into working processes inside an organisation. Typical responsibilities include:
- Mapping personal data and processing activities, and identifying where the organisation acts as a Data Fiduciary or Data Processor.
- Rewriting privacy notices and consent flows, and identifying legitimate uses.
- Setting up processes for data principal rights requests and grievances.
- Defining retention and erasure rules in line with the DPDP Rules.
- Building breach detection, response and notification to the Data Protection Board and affected individuals.
- Managing processors and vendor contracts.
- Running privacy as a management system under ISO/IEC 27701:2025, with evidence ready for audit.
There is no government-issued Data Protection Officer certification in India, and the Act prescribes no qualification for the role.
